What happens after a motorcycle hit and run accident? Hit & Run Wrecks and Special Insurance:
The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.
It happens all the time: a motorcyclist gets hit by a negligent driver, and the driver takes off. A dreaded hit & run, and they never find out who it was. How can you get compensated for your injury when the negligent driver is unknown? How can you sue someone that is unknown?
How Do You Sue the Unknown Driver in a Hit & Run Motorcycle Wreck?
You can have an injury claim or lawsuit against the insurance policy on your motorcycle, but only if YOU were covered by a certain kind of insurance. It is called Uninsured Motorist (UM) Coverage. This coverage allows you to bring the same claims you would have against the negligent jerk that took off. It even applies if the negligent driver is known, but uninsured. Thus, the name: ‘Uninsured Motorist Coverage.’
I recommend carrying at least $250,000 in coverage; the more the better. It usually comes with Under Insured Coverage (UIM) as well. UIM coverage applies when the negligent driver does not have enough insurance to pay the full damages he caused. Many details about insurance are covered in our eBooks.
