How I Shut Down a Defense Attorney When He Says, “Motorcycles Are Hard to See.”
Let’s talk about how to combat a defense attorney who tries to exploit a prejudice against motorcycles. He, in essence, will ask a jury to forgive the defendant because, “You just can’t see these motorcycles.”
I probably shouldn’t disclose this… it’s something I’ve developed, over the years, and has been very effective. When my client testifies, I ask about the light configuration on the front of his motorcycle. Of course, I already know the answer, his Electra Glide has a big center white led headlight, two smaller ones on each side, two amber running lights and an amber light on the front fender. Then I ask my client about his exhaust system. His truthful answer, “I had screaming eagle pipes.”
When I talk to the jury in closing argument, I now get to say, “So ladies and gentlemen of the jury, my client was there to be seen. The car driver had a duty to see what was there. The motorcycle was lit up with 5 different lights. The defendant not only should have seen the motorcycle, but he should have heard it too with those special loud pipes.
