After a Michigan Motorcycle Wreck, How Injured Do You Have to Be to Qualify for Pain-and-Suffering Damages?
Even though a negligent car driver was 100% the cause of a Michigan motorcycle accident, a biker is not entitled to injury compensation unless he or she has a ‘threshold-level injury.’
To meet the threshold there must be either a death, a permanent serious disfigurement, or a ‘serious impairment of body function.’ Death and permanent serious disfigurement is self-explanatory.
To prove ‘serious impairment of body function,’ we basically must show, first, that the injury is medically identifiable. A medical test objectively, and most easily, shows this. For example, an x-ray shows a broken bone. Second, the injury must be to an important body function. And third, the person’s life must be significantly affected.
