Michigan Motorcycle Road Defect Case Notice Required
The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.
If the Michigan motorcyclist crashes because of a road defect, he may have a case against the state or the county responsible for that road. However, a special notice must be timely given.
If the Michigan Motorcyclist Crashes Because of a Road Defect, a Special Notice Must Be Sent Within Days of the Crash
For defective highway claims against the state of Michigan, a notice must be served upon the government agency within 120 days of the crash. If the victim is a minor, then they have 180 days to send the notice. In situations where the County Road Commission is responsible for a defective county roads, bridges or culverts, the notice must be sent within 60 days of the crash.
The time limit to send the notice depends upon which government agency is responsible for the road or defective area. Therefore, I recommend consulting a specializing attorney immediately. We have had two of these cases that have received verdicts or settlements for $2,000,000.
This topic is covered in great detail in our eBook: “Motorcycle Road Defect & Negligent Road Construction Guide” located on the Resources page of this website.
