Three claims after a motorcycle accident

The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.

Michigan motorcyclists get their No-Fault benefits and medical bill payment from the insurance company of the car that hit them (this is the first insurance company responsible to pay the benefits).

Because car (vehicle) drivers now choose the amount of PIP Medical coverage they have, a motorcyclist is stuck with the amount that the negligent car driver chose for the car driver’s PIP Medical coverage. For example, you're struck by another motor vehicle (car, truck or van etc., but not another motorcycle), the at-fault driver's PIP coverage determines the amount of no-fault pip coverage YOU are entitled to receive.

How can a Michigan motorcyclist protect himself/herself? The best thing a motorcyclist can do is to purchase lots of Underinsured/Uninsured Motorist Coverage. Get the maximum you can afford. Unlimited underinsured-uninsured motorist coverage gives you a great amount of protection. You need this on ALL your vehicles and motorcycle(s). This coverage kicks in and kind of takes over when the negligent driver’s insurance limits are exhausted.

An example might help explain. Say the negligent driver only chose $50,000 worth of PIP Medical, and your medical bills are $500,000. Since the car driver only had $50,000 of PIP Medical, you could be stuck owing $450,000. However, if you had $500,000 of Under Insured Motorist coverage on your motorcycle, it would pay the that extra amount; in this example $450,000. This is why I advise purchasing as much Uninsured and Under Insured Motorist coverage you can afford on your motorcycle and all other vehicles.

Remember, NEVER ride your motorcycle without insurance coverage. Without it, no matter who is at fault, you will not be covered by Michigan No-Fault. Accidentally letting your insurance lapse still leaves you exposed to great financial risk, so be sure you are covered before riding.
