1. NO PURCHASE NECESSARY TO ENTER OR WIN.  Purchase or being a client does not increase chance of winning.

3. SWEEPSTAKES: (the “Sweepstakes”) is offered only in and may be entered  in the state of Michigan.  Sweepstakes begins at 12:01 AM Eastern Daylight Time (EDT) on February 10, 2011 and ends at 11:59 PM EDT on  October 1, 2011 (“Sweepstakes Period”)

6. ELIGIBILITY:  The  Sweepstakes is open only to legal residents of the state of Michigan , who possess a valid U.S. driver's license and are 21 years of age or older at time of entry. The “Sweepstakes” is offered only in the state of Michigan.  Employees, and their immediate families (spouses and siblings, parents and children and their spouses) and household members, of any of the "Sponsors", and their respective affiliates, subsidiaries, divisions, dealers, advertising and promotion agencies (“Sweepstakes Entities) are not eligible. Void where prohibited.

7. AGREEMENT TO THE OFFICIAL RULES:  By participating in the Sweepstakes, each entrant fully and unconditionally accepts these Official Rules and the decisions of the Sponsors and the Administrator, which are final and binding in all matters related to the Sweepstakes.  Winning a prize is contingent upon fulfilling all requirements set forth herein. Noncompliance with the Official Rules will result in disqualification and the forfeiture of any prize.

8. HOW TO ENTER:  To enter the sweepstakes go to www.motorcyclelawyermichigan.com and complete the sweepstakes entry form on the $1,000 Giveaway Sweepstakes page and bookmark the site during the sweepstakes period.  Each person may fill out one entry form during the sweepstakes period and will be entered in all five drawings for $1,000 and all five drawings for the free photo shoot.   In the event duplicate entries are received from any one person, no entries from that person shall be valid.  Multiple entries from the same person will be disqualified.  Entries that are incomplete or illegible may be void at the majority vote of the Sponsors. Sponsors are not responsible for late, lost, illegible or damaged entries. Entries become the property of the Sponsor and will not be returned.  By entering or filling out the entry form, you authorize mailing of promotional materials and emails to you by the sponsors and their affiliates.

9. PRIZES/APPROXIMATE RETAIL VALUE (ARV):  There are five $1,000 cash prizes and five photo shoots that have a value of $300.00   Winners are responsible for all taxes (federal, state and/or local) and any other expenses not listed, which relate to acceptance and use of prize.  Prior to taking delivery,  winner must provide valid driver's license or I.D.

10. WINNER SELECTION AND VERIFICATION:    To hold a drawing, there must be 100 entries for each $1,000 drawing for the drawing to be held.  If this number is not met, the entries will go towards the next $1,000 drawing and each additional drawing thereafter, until the end of the contest.  Therefore, if there are not 100 entries for a $1,000 drawing, then that $1,000 drawing will not be awarded.  No matter how many entries there are, the final $1,000 drawing will be picked from all the entries received.  Regardless of the number of entries at the time of each scheduled drawing for the photo shoot drawing, the photo shoot drawing will occur.  The winners will be selected as follows in five  random drawings on or about:     

    • MAY 3, 2011: one $1,000 winner and one photo shoot winner;

    • JUNE 6, 2011: one $1,000 winner and one photo shoot winner;

    • JULY 11, 2011: one $1,000 winner and one photo shoot winner;

    • AUGUST 22, 2011: one $1,000 winner and two photo shoot winners;

    • OCTOBER 3, 2011: one $1,000 winner.

    • from among all eligible entries received.  The process of will be that one entry form shall be drawn for each of the prizes.  The odds of winning depend on the total number of eligible entries received. Drawings will be conducted by an independent person who preferably has a professional license such as a CPA or attorney selected at the Sponsor’s sole discretion. Winner of the prizes need not be present at the final drawing to win and may be required to complete an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release form within seven (7) days of receipt. Failure to timely sign and complete and return any required executed forms will cause the prize to be forfeited and awarded to an alternate winner. Except where prohibited by law, entry and acceptance of a prize constitutes permission for Sponsors to use winner's name, home town, likeness, statements and other personally identifiable information for advertising and marketing of Sponsors’ products, services and consumer promotions in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. Winners may not transfer, exchange or redeem any Prizes for cash; however sponsor(s) reserves the right to substitute, in whole or in part, a prize of comparable or greater value at its sole discretion. If a prize is refused, a prize notification is returned or deemed undeliverable, or potential winner is disqualified for any reason, an alternate winner will be selected. If winner can not be easily reached (email does not work, phone number does not work) or if after reasonable efforts (for example: three attempts to contact by email and three attempts to contact by telephone and after two weeks of last attempt) winner cannot be reached or does not respond, said potential winner is disqualified and will cause the prize to be forfeited and awarded to an alternate winner.

11. RELEASE AND DISCLAIMER OF LIABILITY:  Sponsors and their respective agents are not responsible for 1) any error, omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials or any human errors; 2) for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission or processing of, or failure of Sponsors or agents to receive entry information on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof; 3) any injury or damage to entrant's or any other's person or property, including but not limited to entrant’s computer related to or resulting from participation in the Sweepstakes; 4) entries that are late, lost, misdirected, illegible, damaged, postage-due or otherwise deficient; 5) the cancellation or rescheduling of any Event.   Sponsor reserves the right, in its sole discretion, to terminate, cancel, suspend or modify the Sweepstakes in its entirety, or any portion thereof if its integrity, fairness or proper operation is undermined, or corrupted as a result of technical or other reasons or because of any illegal or non-authorized intervention or any other factor beyond Sponsors’ reasonable control. In that event, Sponsor may select the grand prize winner from all eligible entries received prior to such modification or cancellation and will post notification of such action on its web page: www.motorcyclelawyermichigan.com. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.  By entering, participants (a) agree to be bound by these Official Rules and the decisions of the Sponsors and Administrator, which shall be without legal or other recourse and final in all respects; (b) release all Sponsors and its respective divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies and their respective directors, officers, lawyers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability, except for Sponsor's standard limited warranty provided with the Grand Prize vehicle. Noncompliance with the Official Rules will result in disqualification and the forfeiture of any prize.

12. PRIVACY:  Information collected in connection with this Sweepstakes may be shared with Sponsors’ promotional partners.  By entering the entrants authorize mailing of promotional materials and emails to them by the sponsors and their affiliates and promotional partners.

13. Disputes:  Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Oakland County, Michigan, USA.   All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan USA.  Any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney’s fees.
