Michigan Motorcycle Law: Common Myths and Misinformation

I’ve litigated, handled and been involved in thousands of injury and death cases in Michigan and all over the United States for over two decades. Let’s talk about some of the misinformation out there about Michigan’s motorcycle law.

When I’m the invited speaker for motorcycle groups about accidents, injuries and laws, people often say to me, “I heard if there is no contact to the motorcycle, there’s no case.”

Or, in a hit-and-run crash: “If you don’t know who the hit-and-run driver is, there’s no case.”

Or: “If the wreck involves motorcycle versus motorcycle there’s no case.”

And this is a good one: “If an animal makes you crash, there’s no case.”

Well, in all of these instances, the answer is: It depends.

You don’t need contact with another motor vehicle to have the personal injury case.

Often, contact is required if you’re pursuing an uninsured motorist claim. If you don’t know who the hit-and-run driver is in a motorcycle wreck case, you can still file the same claim with your own insurance on your motorcycle – if you had uninsured motorist coverage.

In a motorcycle versus motorcycle wreck case, you don’t get no-fault benefits but you still can recover all your damages from the other motorcycle operator’s policy.

And lastly animal cases. I’ve helped many motorcyclists who went down because of animals. The animal has to be owned by someone, so with a deer, there’s no case.

But, I’ve had many dog cases and even a goat case. Recovery is available through the owner of the animal’s homeowner’s insurance or, in the case of the goat, the farm’s insurance.
