The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.
Let’s say the negligent driver that hit you only has the minimum policy of $50,000 and your injury is worth way more than that, or you have unpaid medical bills not covered by a No-Fault policy.
You can get more injury compensation, and those medical bills paid, if you had a special kind of insurance on your motorcycle. The special insurance is called Underinsured Motorist coverage. The guy that hit you did not have enough insurance to cover the full extent of your injury or medical bills; he was under insured.
If you purchased Underinsured Motorist coverage, you can obtain more compensation to cover all your damages.
An example helps explain it: Let’s say the at-fault driver has a $50,000 Bodily Injury policy, you have a $500,000 Underinsured Motorist policy.
You have $100,000 of non-covered, unpaid medical bills and your injury is worth $250,000.
The at-fault driver’s $50,000 of Bodily Injury coverage is paid to you, toward your injury. Your Underinsured Motorist policy pays another $200,000 to you for your injury, and another $100,000 to pay the noncovered medical bills.
Everything is paid in full! You are not stuck owing medical bills because you had a significant amount of Underinsured Motorist coverage.
Uninsured Motorist coverage is usually sold with Underinsured, but not always. It does the same thing as described above but applies in the at-fault driver has no insurance at all. I recommend getting both Uninsured Motorist and Underinsured Motorist coverage on all your vehicles, including your cars, trucks, vans and motorcycles.
