Do Motorcycles Get Michigan No-Fault Benefits?

Bikers Are Not Always Entitled to No-Fault Benefits

Motorcyclists Shafted Series: 2 of 4

The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.

Motorcyclists Often Get Shafted Under Michigan Law

Motorcyclists often get shafted under Michigan law. One major way bikers get shafted is that motorcyclists do not always get no-fault benefits after a wreck.

If an insured car driver is in a crash, he/she gets no-fault benefits which includes payment of wages, medical bills, house chores and medical mileage. That’s not true for an insured motorcyclist. Only when a car, truck or van is involved in the motorcycle accident does the biker get those benefits.

Why? Because they wrote the No-Fault law to say only when a ‘motor vehicle’ is involved are No-Fault benefits payable. And guess what? They specifically left out ‘motorcycles’ from the definition of ‘motor vehicle.’

That’s right, a motorcycle is not a motor vehicle under our No-Fault law!
